AKC Reunite Pet Disaster Relief Donation Terms

This document outlines the terms applicable to donations received by the American Kennel Club Companion Animal Recovery Corporation (“AKC Reunite”) in connection with AKC Reunite’s Pet Disaster Relief Unit initiative, which will run for two years beginning on September 10, 2013 (the “Term”).

Donations made to AKC Reunite for the purpose of purchasing AKC Pet Disaster Relief Units (“Units”), which in turn are to be donated to qualified tax-exempt organizations and government units or instrumentalities

[1] (“Donations”) will be allocated to one of three sub-funds: the General Fund, the Restricted Fund, and the Reserved Designation Fund, each of which is described in further detail below.

Any Donations not used by AKC Reunite to purchase a Unit to be donated to a qualified tax-exempt organization or government unit or instrumentality will be used by AKC Reunite, in its sole discretion, for other disaster-related purposes.

General Fund

Where a donor does not expressly indicate that its Donation is being made in connection with a specified AKC member or licensed club, the Donation will be allocated to the General Fund.  Donations allocated to the General Fund will be used by AKC Reunite, along with additional funds provided by AKC Reunite, to purchase Units to be donated to qualified tax-exempt organizations and government units or instrumentalities selected by AKC Reunite in its sole discretion.  Any Donations remaining in the General Fund after the end of the Term will be used by AKC Reunite, in its sole discretion, for other disaster-related purposes.

Restricted Fund

Where (i) a donor expressly indicates that its Donation is being made in connection with a specified AKC member or licensed club, (ii) the specified AKC member or licensed club has undertaken to sponsor a specific tax-exempt organization or government unit or instrumentality, and (iii) the specified organization, unit or instrumentality has been approved by AKC Reunite to receive the donation of a Unit, the Donation will be allocated to the Restricted Fund.  Once sufficient Donations have been raised with respect to the specified AKC member or licensed club, AKC Reunite will contribute additional funds, purchase a Unit and donate the Unit to the specified tax-exempt organization or government unit or instrumentality.  Donations remaining in the Restricted Fund with respect to any AKC member or licensed club on the first day of the calendar quarter immediately following the 12-month anniversary of the date of any Donation

[1]  To be eligible to receive the donation of a Unit, an organization must be a tax-exempt organization whose mission includes animal-related disaster relief activities, directly related to companion animals and service animals, or a government unit or instrumentality.  Potential recipient organizations should refer to the AKC Pet Disaster Relief Unit Grant Guidelines and Application for further information and eligibility requirements.

Reserved Designation Fund

Where (i) a donor expressly indicates that its Donation is being made in connection with a specified AKC member or licensed club, and (ii) the specified AKC member or licensed club has not identified a specific tax-exempt organization or government unit or instrumentality to sponsor, or the specified AKC member or licensed club has undertaken to sponsor a specific tax-exempt organization or government unit or instrumentality that has not yet been approved by AKC Reunite to receive the donation of a Unit, the Donation will be allocated to the Reserved Designation Fund.  Once the AKC member or licensed club has specified a tax-exempt organization or government unit or instrumentality and that organization, unit or instrumentality has been approved by AKC Reunite to receive the donation of a Unit, the Donation will be reallocated to the Restricted Fund.  Any Donations reallocated to the Restricted Fund will be subject to the Restricted Fund terms set forth above.  If the AKC member or licensed club fails to designate a tax-exempt organization or government unit or instrumentality that is approved by AKC Reunite to receive the donation of a Unit on or prior to the first day of the calendar quarter immediately following the 12-month anniversary of the date of any Donation, the Donations will be reallocated to the General Fund.  However, an AKC member or licensed club may request an extension of such time period in writing, which extension will be granted by AKC Reunite in its sole discretion.  Donations remaining in the Reserved Designation Fund at the end of the Term will be reallocated to the General Fund.  Any Donations reallocated to the General Fund will be subject to the General Fund terms set forth above.
